Algerian Legislation in the Face of Cybercrime

The law on the fight against cybercrime, No. 09-04 of 14 Sha'ban 1430 corresponding to August 5, 2009, is the main legal text that governs online criminal acts in Algeria.


It aims to protect individuals and institutions against cyberattacks, fraud, and identity theft.


It defines several offenses, including:

  • Hacking ;

  • Digital fraud ;

  • Identity theft ;

  • Spreading viruses or malware ;

  • Invasion of privacy.


Sanctions Provided by the Law


In Algeria, sanctions are outlined in Law No. 09-04 of August 5, 2009. They vary depending on the nature and severity of the offense.


Prison Sentences

  • Hacking can result in a prison sentence of 2 to 5 years.

  • Identity theft is punishable by prison sentences of up to 5 years, depending on the circumstances.

  • Cyber fraud can be punished with prison sentences ranging from 5 to 10 years, depending on the extent of the damage caused.


Fines

  • Hacking or digital fraud may incur fines ranging from 100,000 to several million Algerian dinars.

  • In some cases, the fine may also be accompanied by a ban on engaging in certain professional activities.
