Alimony

Alimony is a legal obligation established by the court, taking into account the needs of the beneficiaries and the financial capacity of the concerned parties.
The father who does not have custody rights must pay alimony until the child reaches adulthood, which is 19 years for boys and until marriage for girls. This obligation continues if the child is physically or mentally disabled or is still in school.
Criminal penalties for non-payment of alimony are provided for in Article 331 of the Penal Code, which states:
"Anyone who, in defiance of a court decision made against them or in violation of an order or judgment requiring them to pay alimony to their spouse, ascendants, or descendants, remains willfully in default for more than two (2) months without providing the full amount of the financial support determined by the judge or failing to pay the full alimony amount, shall be punished by imprisonment for six (6) months to three (3) years and a fine of 50,000 DA to 300,000 DA."
