Marriage Conditions in Algeria

The family occupies a central place in Algerian society. According to Article 2 of the Family Code: "It is the basic unit of society," which highlights the importance attached to it in Algeria.


Composed of people united by the bonds of marriage and kinship, all relationships between members are governed by the Family Code.


As for marriage, it is undoubtedly regulated by legal provisions that must be respected by each party.


Furthermore, Algerian legislation recognizes a marriage as valid when it meets certain specific and irrevocable conditions set out in the Family Code.


For example, it is required to meet conditions such as age, the dowry, and the presentation of a "medical certificate, dated less than three (3) months ago, certifying that the individuals are not suffering from any disease or do not present any risk factors that would contraindicate the marriage" (Article 7 bis of the Family Code).


Moreover, it is important to note that, according to Article 6 of the Family Code, the "Fatiha" ceremony, which accompanies the engagement "El Khitba," does not constitute a marriage.
